This privacy statement explains how FESTIVAL MODEM d.o.o. for services, Slunj (hereinafter: FESTIVAL MODEM) processes your personal data. FESTIVAL MODEM is focused on the protection of your personal data and their processing in accordance with the General Data Protection Regulation and the Law on the Implementation of the General Data Protection Regulation.

- Purposes for which we process personal data
We process your personal data because the law requires certain actions, ie because the processing is necessary for the execution of the contract, or to take actions before concluding the contract or based on our legitimate interests, except when the interests or fundamental rights and freedoms of individuals requiring the protection of personal data are stronger than that interest.
If we cannot process personal data on the basis of the stated legal grounds, we will ask for your consent. If the processing is based on your consent, you have the right to withdraw your consent at any time.
Withdrawal of consent must be notified to the head of personal data processing (processing manager) by e-mail jelena@modemfestival.com, or to the address FESTIVAL MODEM d.o.o., Donje Primišlje 11, 47240 Slunj, Republic of Croatia, with the entry “For the head of personal data processing FESTIVAL MODEM d.o.o.“.
Such withdrawal shall not affect the lawfulness of processing on the basis of consent prior to its withdrawal.
We process your personal data when necessary to enter into and fulfill the rights and obligations arising from the sales contract, for marketing purposes, for the purpose of improving our business and your user experience (eg when you buy or order products and / or services from us, when you contact us by phone or email, etc.).
We generally collect personal information directly from you when you order certain products or services or fill out a certain form.
- Categories of personal data
When concluding a sales contract, we need information such as name, surname and address in order to fulfill our contractual obligation to deliver products and services.
Sometimes we ask for additional personal information such as contact number and email address, shipping address, financial information including credit and debit card information or other payment information you provide to us when filling out forms on our website or when you communicate with us by phone or email and additional information that you choose to voluntarily share with us.
FESTIVAL MODEM d.o.o. collects data on potential customers, with the purpose of informing them in a timely and accurate manner about the current special offers and promotions, exclusively in the services for which potential customers have expressed interest. For this purpose, we collect only basic personal data (name and surname, contact phone number, contact e-mail and product in which interest is expressed).

Right of access. You have the right to receive confirmation from us as to whether your personal data is being processed and, if such personal data is being processed, access to personal data. Access to information includes, inter alia, the purposes of the processing, the categories of personal data in question, the recipients or the categories of recipients to whom the personal data have been or will be disclosed. However, this is not an unconditional right and the interests of other individuals may limit your right of access.
You have the right to receive a copy of the personal data being processed. For further copies you have requested, we may charge a reasonable fee based on administrative costs.
Right to correction. You have the right to obtain from us the correction of your inaccurate personal data. Taking into account the purposes of processing, you have the right to supplement incomplete personal data, including by giving an additional statement.
Right to erase (“right to forget”). Under certain conditions, you have the right to obtain from us the deletion of your personal data and we are obliged to delete such personal data.
The right to limit processing. Under certain conditions, you have the right to obtain from us a restriction on the processing of your personal data. In this case, the relevant data will be marked and can only be processed for certain purposes.
The right to object. Under certain conditions, you have the right to object to the processing of your personal data at any time, for reasons related to your specific situation or when personal data is processed for direct marketing purposes and you may ask us not to process your personal data anymore.
The right to data portability. Under certain conditions, you have the right to receive personal data relating to you, provided to us in a structured, usable and machine-readable format, and you have the right to transfer this personal data to another processing manager, without our interference.

- Storage of personal data
We keep the personal information we collect about you in a secure environment. Your personal information is protected from unauthorized access, disclosure, use, alteration or destruction by any organization or individual.

Your personal data will not be kept in a form that allows you to be identified for longer than the processing manager reasonably deems necessary to achieve the purpose for which it was collected or processed. The processing manager will keep certain personal data for a period of time prescribed by law or a regulation that obliges the processing manager to keep the data.
If you have given us consent, we will process your personal data until the consent is withdrawn.
In the event that you make a well-founded objection to the processing of personal data on the basis of a legitimate interest, we will not process your personal data in the future.
Furthermore, if judicial, administrative or extrajudicial proceedings are instituted, personal data may be stored until the end of such proceedings, including a possible period for declaring remedies. The processing manager will keep certain personal data for a period of time prescribed by law or a regulation that obliges the processing manager to keep the data.
- Recipients of personal data
It is important to note that we may provide your personal information to our trusted partners who provide services on behalf of and for the account of the processing manager. For example, for sending emails and newsletters. The mentioned service providers are obliged, according to the relevant contracts, to use the data entrusted to them only in accordance with our guidelines and exclusively for the purpose we have strictly determined. We also oblige them to adequately protect your data and to consider it a business secret.
We emphasize that the law prohibits the disclosure of your personal data to any third party contrary to the regulations governing the protection of personal data, and that we act accordingly.
- Transfer to third countries
MODEM FESTIVAL d.o.o. uses tools and services of social networks based outside the EU. We are required to warn you that third parties who operate these social networks may transfer your personal information to the United States where it is shared with intelligence services in accordance with the regulations in force in the United States.
We care about the protection of your data and that is why we have launched mechanisms that will enable an even higher level of your protection.
