Terms & Conditions
This document sets out the terms and conditions between Festival Modem d.o.o (Hereinafter referred to as “Modem Festival d.o.o.”) and you when you purchase a ticket. By purchasing a ticket you are agreeing to comply with and be bound by these Terms and conditions. You should read this document carefully.
Modem Festival d.o.o. reserves the right to change these Terms and conditions at any time. Any amended Terms and conditions will be posted to this website. Please check this section regularly for changes to ensure you have up to date information as you are bound by these Terms and conditions. If you purchase a ticket after any amendment to these Terms, you agree to be bound by the updated version of these Terms.
In the event of any breach of these Terms and conditions, Modem Festival d.o.o.reserves the right to cancel tickets, to refuse admission, to remove the holder or to confiscate offending articles, as the case may be, and in any case, to retain any monies paid for the relevant ticket.

GENERAL INFORMATIONS
The products on the web shop represent an invitation to purchase and Modem Festival d.o.o. will decide on the acceptance of the offer given by the consumer.
The conclusion of a contract via the website https://shop.modemfestival.com/ is the conclusion of a distance contract and the acquis communautaire, including the regulations of the Republic of Croatia, applies to it.
These terms of use regulate the relationship between the consumer and Modem Festival d.o.o. A consumer is any natural person who enters into a legal transaction or operates on the market outside his trade, business, craft or professional activity.
The buyer and the seller are bound by these Terms and conditions, and in the event that a certain provision is contrary to the mandatory regulations of Croatian law, the mandatory regulations will apply.
The content of the website https://shop.modemfestival.com/ is protected by intellectual property rights. Buyers and users of the website https://shop.modemfestival.com/ may not dispose of the intellectual property rights of Modem Festival d.o.o. without prior approval.
Users and / or buyers of the product are obliged to refrain from harming third parties and are obliged to take actions to reduce any damage.
Modem Festival d.o.o. is in no way responsible for the damage that the user may suffer by using the website https://shop.modemfestival.com/, unless Modem Festival d.o.o.’s liability is regulated by mandatory regulations of the Republic of Croatia.
Customers bear the costs of using computer equipment and telecommunications services required to access the website https://shop.modemfestival.com/.
Modem Festival d.o.o. makes constant efforts to ensure optimal operation and quality of the website. Modem Festival d.o.o. cannot guarantee that the use of the website will not be interrupted or temporarily unavailable.
Modem Festival d.o.o. reserves the right at any time and without prior notice to modify, supplement or discontinue any part of its business, including the Website, or any part thereof, services, subpages or services provided through them. The law in question includes, but is not limited to, changes in the time of availability of content, the availability of new data and the method of transmission.
Modem Festival d.o.o. reserves the right to change or amend the Terms and conditions at any time. All changes and amendments come into force on the day of publication on the website https://shop.modemfestival.com/.
The contracting parties are obliged to act in accordance with the principles of conscientiousness and honesty, the prohibition of causing damage and the duty to fulfill obligations.
THE INTRODUCTION OF THE EURO AS THE OFFICIAL CURRENCY IN THE REPUBLIC OF CROATIA
On our web shop, the prices of products and services are expressed in kuna. In accordance with the Law on the introduction of the euro as the official currency in the Republic of Croatia (Official Gazette 57/22, 88/22), from September 5, 2022, on our web shop, we will start with a dual display of prices in kuna and euros, whereby 1 euro is HRK 7.53450.
The aforementioned double display of the prices of products and services on our web shop does not constitute an invitation to pay in euros, but only serves to protect consumers, in order to understand which of our products or services certain prices refer to, as well as the possibility of checking whether the prices are correctly calculated.
All products and services ordered or purchased through this web shop are still paid for in kuna, and in case of product return, the amount paid is also returned to the customer in kuna.
The above is valid until January 1, 2023, when the euro becomes legal means of payment in the Republic of Croatia.
General provisions
On January 1, 2023, the euro becomes legal means of payment in the Republic of Croatia.
In accordance with the introduction of the euro as an official monetary unit and legal means of payment, on September 5, 2023, the period of dual reporting of prices and other monetary value statements will begin.
From January 1, 2023 to January 14, 2023, there is a period of double circulation.
On January 1, 2024, the obligation of dual reporting of prices ends.
Until September 5, 2023, dual reporting of prices and other monetary value statements is voluntary. After the specified date, dual reporting becomes an obligation of FESTIVAL MODEM d.o.o.
Basic principles in the process of introducing the euro
In the process of introducing the euro, the following principles are applied:
The principle of consumer protection – recalculation of prices and other monetary statements of value is carried out free of charge, using a fixed conversion rate
The principle of the prohibition of unjustified price increases – it is forbidden to increase the price of goods or services for consumers without a justified reason when introducing the euro.
The principle of continuity of legal instruments – the procedure for introducing the euro does not affect the validity of existing legal instruments in which the kuna is mentioned.
The principle of efficiency and economy – the introduction of the euro and all related procedures and activities are carried out in such a way as to ensure the simplest possible treatment for everyone with as few costs as possible.
The principle of transparency and information – information about the introduction of the euro must be clear, understandable, accessible, legible and visible.
Rules on the application of the euro
Amounts specified in kuna in legal instruments are considered amounts in euro with the application of a fixed conversion rate and in accordance with the rules for conversion and rounding from the Act on the introduction of the euro as the official currency in the Republic of Croatia (Official Gazette 57/2022).
Reference to the kuna without specifying the amount in legal instruments is considered a reference to the euro.
Amounts stated in legal instruments in euro that are converted into kuna equivalents according to the middle exchange rate of the Croatian National Bank or another bank exchange rate until the date of the introduction of the euro are considered amounts in euro.
From January 1, 2023, the Croatian National Bank publishes the exchange rate list of the Croatian National Bank for the euro in relation to other currencies.
Rules for recalculation and rounding
Monetary amounts that must be paid or calculated are converted using a fixed conversion rate in accordance with the rules for conversion and rounding from Articles 4 and 5 of Regulation (EC) no. 1103/97.
The aforementioned conversion is performed by applying the full numerical amount of the fixed conversion rate and rounding the obtained amount in accordance with the mathematical rules of rounding, whereby the obtained result is rounded in accordance with the rules for conversion and rounding, to two decimal places, based on the third decimal place.
The following mathematical rounding rule applies:
• if the third decimal place is less than five, the second decimal place remains unchanged
• if the third decimal is equal to or greater than five, the second decimal is increased by one.
Unit prices of low value expressed for accounting units of goods and services that are used as a multiplier for calculating the price of goods and services and other low value prices, recalculated in accordance with the rules for recalculation, are rounded and expressed to more than two decimal places.
Rules for dual pricing
FESTIVAL MODEM d.o.o. is obliged, during the period of dual reporting of prices, to dual report the price of goods and services in a clear, legible, visible and easy-to-see manner in euro and kuna with the application of a fixed conversion rate and in accordance with the rules for conversion and rounding:
– in the business premises at the point of sale or on the goods or on the price list if it is a service
– on the website
– in an offer or contract on a permanent medium
– in the notification that is given to the consumer before or during the conclusion of a contract outside the business premises and a distance contract
– during advertising in any form offering the sale of goods or services
– in the reminder and other notification about the outstanding debt that is delivered to the consumer, the total amount of the debt
– through other forms of price disclosure.
Exceptionally, the obligation to dual reporting of prices of goods and services does not apply to advertising through radio programs and voice messages about other forms of advertising.
In addition to the other exceptions highlighted in Article 44, paragraph 4 of the Law on the introduction of the euro as the official currency in the Republic of Croatia, the obligation to dual reporting of prices does not apply to the discount coupon and the coupon for the value of the returned goods.
Double reporting on the account
FESTIVAL MODEM d.o.o. is obliged during the period of dual reporting of prices, when issuing the bill to the consumer, to dual report the total amount on the bill along with the display of the fixed conversion rate.
METHOD OF PAYMENT
Payment for the tickets can be made with credit cards.
In case of unsuccessful payment authorization, the purchase process is terminated. You are responsible for the correctness of the information provided using the web shop service.
If you decide to pay by credit card, select the online credit card payment option and click on “BUY” and within the WSPay interface select the type of credit card you want to pay with (Mastercard, Maestro, Visa and Visa Premium) and enter the required information. When you click “BUY”, you will see information about your order. Then select “Order Confirmation” and your purchase is complete. You will receive a confirmation of the order to your e-mail or we will contact you by phone if for some reason the order cannot be realised as soon as possible. The WSPay system will also automatically send you a confirmation email about the pre-authorisation of your card for the specified amount.
Payment is considered made at the time the payment is recorded in Modem Festival d.o.o. system or at the time of receipt of authorisation by the card issuer.
The agreed purchase price includes VAT and is expressed in Croatian kuna or/and Euros.
Please note that the means of payment in the Republic of Croatia is the kuna, and the buyer pays the cost of currency conversion.
Payment for the tickets can be made with bank cards.
In case of unsuccessful payment authorization, the purchase process is terminated. You are responsible for the correctness of the information provided using the web shop service.
Payment is considered made at the time the payment is recorded in Modem Festival d.o.o. system or at the time of receipt of authorization by the card issuer.
ADMISSION & TICKETS
Tickets are only available online from official Modem Festival d.o.o. shop or directly through Modem Festival d.o.o. ambassadors.
Do not buy tickets from other sources, as invalid tickets will not be allowed entry into the festival site.
All customers who place an order via the website https://shop.modemfestival.com/ are required to read the Terms and conditions before ordering.
The purchase is made by filling in the form provided on the website https://shop.modemfestival.com/.
The purchase of products in the name and on behalf of a minor or a person deprived of legal capacity (in whole or in part) may be requested only by their legal representatives.
When filling out the form, you are obliged to enter all the information required of him so that the delivery went smoothly.
Purchases via the website https://shop.modemfestival.com/ are possible 24 hours a day, 7 days a week. you will be notified by email of the receipt purchase.
If Modem Festival d.o.o. does not fulfill the contract within the deadline, it will inform you in writing without delay. You have the right to terminate the contract only if he gave the web shop Modem Festival d.o.o. a subsequent reasonable deadline for fulfillment, unless the circumstances of the case indicate that the trader will not be able to fulfill the contract even at a later date.
On the website https://shop.modemfestival.com/ it is possible to make an order as a guest, ie without registration. In that case, you will be asked only for the information that is important for processing the order.
Tickets purchased from Modem Festival d.o.o. ambassadors are exempt from the booking fee.
Modem Festival d.o.o.tickets are issued in electronic form as an “e-ticket”. Modem Festival d.o.o. does not issue any “physical tickets”.
Your email address is used as a form of identification and Festival Modem d.o.o considers a purchased ticket as delivered after sending the ticket to this address.
Modem Festival d.o.o. e-tickets are personalised and need to be registered with valid name and surname. There will be no admission without a valid ticket. Please check all your tickets on purchase, as mistakes cannot always be rectified.
Tickets bought from ambassadors are personalised immediately by the ambassador, and tickets bought online need to be personalised by you immediately upon purchase.
You may purchase more than one ticket per transaction. You must provide the name and surname of each participant while placing an order.
It is not possible to continue the purchase without checking the box “I accept the Terms and Conditions and privacy policy” which marks you confirm that you have read and understood these Terms and conditions and that you agree with them.
After successfully placing and paying for your order you will be emailed a “purchase confirmation”, this is NOT your e-ticket. E-ticket will be sent subsequently by Modem Festival d.o.o. Purchases made through Modem Festival d.o.o. ambassadors will be processed and sent to the email address you provided.
Ticket(s) cannot be exchanged, transferred or resold. If this ticket(s) is re-sold or transferred for profit or commercial gain by anyone other than Modem Festival d.o.o. or one of its authorised sub-agents, it will become void and the holder may be refused entry or removed from the site.
Upon arrival at the festival your e-tickets are only valid in combination with valid ID or passport. Your ID or passport must match the name on your e-ticket. We do not accept written mandate to transfer personalised tickets.
Valid Tickets purchased for Modem Festival d.o.o. will be replaced at the festival entrance with a festival wristband. Only visitors with a valid festival wristband are allowed entry and movement in the festival area. Festival wristbands may not be removed, cut, torn or damaged in any way or they cease to be valid. The festival reserves the right to request identity validation by presenting a valid ID to the festival staff upon request.
Due to the Croatian tourist law each attendee is required to pay tourist tax. This can be paid upon arrival directly to tourist board located at the gate of the festival.
Modem Festival d.o.o. may decline or forbid entrance into the festival to anyone who might in any way endanger the safety of the visitors or cause any kind of problems.
Admission and participation at the festival is at the visitors own risk. Modem Festival d.o.o. and the Landowner will not be held liable for any loss, injuries or damages sustained at the event including damage, theft or losses to property and motor vehicles, if the cause is due to the negligence of the ticket holder or the unforeseeable actions of other patrons or third parties.
During the duration of the special form of sale at prices lower than the prices in regular sales, Modem Festival d.o.o. is obliged to indicate the price applied during the special form of sale and the lowest price applied during the period of 30 days before the implementation of the special form of sale.

If you have not received the purchased tickets that you paid for within the agreed delivery time, please inform Modem Festival d.o.o. about it at the e-mail address shop@modemfestival.com.
CAMPERVAN PASS
The Campervan Pass allows access to the campervan areas, without this pass access is not possible.
Below is a breakdown of the types of vehicles allowed and not allowed.
If the customer is unsure please contact info@modemfestival.com before purchasing the pass as refunds are not possible.
ALLOWED
– Caravans, Campervans, Motorhomes –
– Converted live in vans – must be permanently converted
– Vehicles with rooftop tents – permanently installed
– Trailer tents towed by a vehicle – vehicle will be parked in and unable to leave the campervan area during the festival.
NOT ALLOWED
– Vehicles with no conversions or mobile home installations
– Vehicles with the seats down and a mattress
– Vehicles with a ground tent on top of the roof
– Vans/Caddys with only a mattress inside and no other mobile home installations
This pass cannot be refunded, however transfers are allowed. Transfers can be done within the Mo:DemSpace portal. Transfers close by the date specified by the organisation.
The rules above must be adhered to in order to utilise this Campervan Pass with the correct type of vehicle to enter the campervan areas. Mo:Dem Festival will not be held responsible if these rules are not abided by and therefore access is denied.
It is the customers responsibility to check with the organisation before arriving if the type of campervan they have qualifies for access to the campervan area.
MO:DEM EXPRESS
Mo:Dem Express tickets are personalised and need to be registered with a valid name and surname. Name changes are not possible, tickets cannot be exchanged, transferred or resold.
You cannot board a Mo:De Express without a valid Mo:Dem Festival 2023 Ticket.
Mo:Dem Express tickets are refundable. Refund requests will be accepted from the start of the new year, through Mo:DemSpace on the Mo:Dem website.
Completed refund request forms and refund cancellations for Mo:Dem Express tickets must be received by the date specified by the organisation. Any Mo:Dem Express tickets bought after this date are not refundable.
Please print your Mo:Dem Express ticket out or have it downloaded on your phone and present it to the shuttle driver upon arrival.
Please notice that this ticket is valid only with an official document (ID or passport) that contains your picture and personal information that matches with the name on the ticket.
Mo:Dem Express tickets are personalized, and can only be used by the person mentioned in the heading. We do not accept a written mandate to transfer personalized tickets.
MERCHANDISE SHIPPING
Currently shipping is only available within the European Union, Switzerland and Norway.
Delivery times depend on the item and country of destination, usually between 8-10 working days but can take up to 1 month.
You will receive an email once your order is shipped, including a tracking number to follow the delivery process.

We aim to deliver all orders within specified delivery times. Unfortunately, for reasons beyond our control, deliveries may occasionally be subject to delays.
Please understand that we have no influence on the duration of the shipment, this is the sole responsibility of the shipping service.
FESTIVAL TICKET REFUND POLICY
Refund requests will be accepted from the start of 2023, through a person’s individual Mo:DemSpace account : https://modemfestival.com/modemspace-log-in/.
Completed refund request forms and refund cancellations for 2023 tickets must be received by 23:59 CEST on 31st May 2023.
The pace of refunded ticket payments depends on achievement of additional sales of refunded tickets. Refunded tickets will go on sale in June 2023.
Refunds are not possible for tickets bought in the June 2023 resale phase.
E-ticket refunds will be processed from the 1st of June 2023 onwards. Due to different laws and bank policies, the payment process may last until the 30th of June 2023.
The ticket buyer is able to request refunds for any ticket purchased within their order.
Please make sure your bank info is correct, if the correct banking information is not provided this will delay your payment and possibly incur extra bank fees for returned funds.
Some refunds (mostly those outside of the European Union) will be subject to additional bank charges. This is a shared expense between our bank and yours, meaning each bank will take away a certain fee from the original amount Mo:Dem paid for your refund. In some cases, depending on the bank, this fee can be fairly high.
Due to unforeseen circumstances, refund processing times may be delayed until after the festival takes place.
If you think you have been charged incorrectly or there was a problem with your payment, please contact shop@modemfestival.com.
MERCHANDISE REFUND & RETURNS POLICY
You can request a full refund within 14 days of placing your order. If your order has already been shipped you will need to return the goods to Mo:Dem Shop at your own expense.
Your refund will be processed within 14 days of receiving your cancellation request. However your refund may be delayed if we did not receive the goods back or evidence that you have returned it in the form of a tracking code and payment receipt of postage.
In some cases we can issue a voucher for the shop instead of a refund payment if you prefer.
If your product gets damaged during the shipping process we can repair the item for you if possible or replace it. You will need to contact us and inform us of the damage with pictures of the damage and the packaging. You will then need to return the item to us and we will ship the repaired or replaced item back to you at our cost.
FORCE MAJEURE
In the case of circumstances beyond normal control, such as war, civil or political unrest, actions and orders from the authorities, strikes, catastrophes, epidemics or other severe damages or highly unexpected factors Modem Festival d.o.o. may cancel the Festival, and the amounts received will not be refunded.
NOTICE ON THE MANNER OF WRITTEN COMPLAINT OF THE CONSUMER
In accordance with the best and fair business practice, and in accordance with Art. 10 of the Consumer Protection Act, we ask you to submit a written complaint expressing your dissatisfaction with the purchased product, service or business by mail to the address:

When submitting a complaint that was not sent by e-mail, it is important to provide accurate information about your name and surname and address in order for Modem Festival d.o.o. to be able to provide you with a response within the legal deadline.
Modem Festival d.o.o. will acknowledge receipt of your complaints in writing or by e-mail without delay.
Modem Festival d.o.o. will respond to you in writing by mail or e-mail within 15 days from the date of receipt of your complaint in accordance with the notice on how to file a written complaint, clearly stating whether it accepts the merits of your’s complaint.

DISPUTE RESOLUTION
In the event of a dispute, Modem Festival d.o.o. and you will try to resolve the dispute amicably.
If the dispute cannot be resolved amicably, the court with actual and territorial jurisdiction in the Republic of Croatia with the application of Croatian law shall have jurisdiction, unless the applicable regulations prescribe otherwise.
Disputes can be resolved before the Court of Honor or other conciliation centers.
Your disputes can be resolved through the European Commission’s ODR platform https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=EN.
AGE POLICY
Only persons aged 18 years or over on their first day of attending Modem Festival d.o.o.may enter the festival using an adult ticket.
If you have purchased an adult ticket you will be required to provide ID that proves your age. If you cannot provide a valid ID or passport that is valid and in date, you will be refused entry into the festival site.
Ticket holders under the age of 18 years can only enter the festival with the person who purchased their ticket i.e. their parent, legal guardian. Any under 18 ticket holders attempting to enter the festival without this person will be denied entry to the festival.
Children aged 14 years and under are admitted free when accompanied by a ticket-holding parent or a legal guardian.
Parents need to register their children at children@modemfestival.com with following information: child’s name, surname and date of birth; parents address and contact number; next of kin & emergency contact information (name and phone number).
It’s worth bringing official document if child looks older than 14 years.
The following documents are considered acceptable proof of identity: A passport or national identity card. Photocopies will not be accepted.
All young persons are the responsibility of their adult parents or legal guardian, at all times whilst at the festival.
Under aged and visibly intoxicated individuals will not be served alcoholic drinks.
MEDIA POLICY
All visitors (including minors) give their express consent to be photographed, filmed or recorded as part of the audience. All video, photo and audio materials acquired on festival site is subject to be used in promotional materials for the festival without any limitations of time and space and at the sole discretion of Modem Festival d.o.o.
By entering the event and by your presence at the event site, you acknowledge that you may be photographed and recorded as part of such footage and its use in distribution (commercial or otherwise) without any payment.
GENERAL
Modem Festival d.o.o. reserve the right to alter or vary the content or timing of the whole or any part of the event due to circumstances beyond our reasonable control without being obliged to refund or exchange tickets. When purchasing your ticket you will be asked to provide your customer details, including a contact info. We will use your information to keep you up to date on Modem Festival d.o.o. events. To opt out of these communications please contact shop@modemfestival.com.
Strictly no trading or other commercial activity by any ticket holder will be allowed on the festival site without Modem Festival d.o.o. prior written consent.
Modem Festival d.o.o. accepts no responsibility for goods or services purchased from third party traders.
Tickets cannot be used as part of any marketing, media or sales promotion whether commercial or non-commercial without prior written permission of Modem Festival d.o.o.
To protect your own safety and those of other guests, please act responsibly.
If you are caught urinating or defecating in places other than a toilet, you run the risk of immediate ejection from the festival site.
Please use bins and recycling points provided.
The burning of plastics, bedding, tents, furniture is not permitted anywhere on the site and could result in criminal charges being brought against anyone caught doing so.
Anti-social behaviour will not be tolerated and anyone found acting in such a way will be immediately ejected without refund. It is strictly forbidden to build fires or barbecues anywhere on festival grounds.
Dogs are allowed on the site.
Pyrotechnics, lasers, smoke machines, strobe lighting and special effects may take place during some performances.
Parents are reminded that some areas of the festival, especially immediately in front of the stages, are inappropriate for children.
WARNING: Exposure to loud and excessive music may be damaging to your hearing!!!
PROHIBITED ITEMS
The following items are not permitted:
- We operate a zero tolerance on drugs / legal highs and entry will be refused for those attempting to enter the event with any illegal substances.
- Glass (of any kind).
- Spray cans.
- Laser equipment or laser pens.
- Gas canisters.
- Fireworks, flares, Chinese lanterns, klaxons, air horns or other similar items capable of making loud noise and any item which may reasonably be considered for use as a weapon.
- Motorcycles, motor scooters, personal motorised vehicles (unless a mobility scooter).
You may be searched on entry to the event site. Any items that may be used in an illegal or offensive manner will be confiscated. No responsibility is given for the return of confiscated items. If you are in possession of illegal substances you may be arrested.
CAMPING
Camping will be made possible only to visitors with a valid festival ticket. Camping is allowed only on the designated camping area.
It is forbidden to set up tents outside of the fenced area of the camp or restricted areas of the festival camp.
Unregistered people and anyone without a valid festival camping wristband cannot enter the festival camp site and campers are not allowed to escort such individuals onto the festival camp site.
CARAVANS & CAMPERVANS
Each person in the campervan must have a valid festival ticket.
No tents may be erected in the campervan parking areas for fire safety reasons. Stewards will park you in position, please follow their direction and keep fire lanes clear.
No trading is permitted from caravans or camper vans.
Toilets are provided in the campervan parking areas and we recommend that attendees use these toilets rather than their own chemical toilets. If you are using your own chemical toilet, please note you must take the waste away with you. There are no facilities for accepting chemical waste and it must not be poured into the compost toilets. It is illegal to pour this waste onto the ground, into a sump or stream and anyone found doing this will be evicted from site and face a fine from the Environment Agency.
Whilst every effort will be made to accommodate campervans / caravans in your preferred caravan parking area, Modem Festival d.o.o.reserves the right to provide alternative facilities if deemed necessary or in the event of adverse conditions.
All litter must be cleared from your pitch and put into bins provided or taken home with you.
Cars are not deemed as live-in vehicles. Only converted live-in vans, campervans, caravans or trailer tents are classes as live-in vehicles.
There is no electrical hook up and generators are not permitted on site.
Security staff patrol the caravan parking and reserve the right to evict persons from the campervan field if they do not adhere to the terms and conditions.
CAR PARKING
Car parking will be made possible only to visitors with a valid festival ticket.
Vehicles are parked entirely at owners risk.
All car parking is not pre-designated and will be allocated on arrival at our discretion.
Any vehicle left on site past the given deadline will be removed and scrapped. All reasonable efforts will be made by Modem Festival d.o.o. to locate the owner and remove the vehicle before this takes place.
Modem Festival d.o.o. accepts no liability for costs incurred in the process of removal and disposal of vehicles. If a vehicle is stored beyond given deadline, to facilitate collection any associated costs will be passed on to the legal owner.
